2026 Camp Participant Waiver
Version 2026-11-05
IMPORTANT: This document affects legal rights. Please read it in full before signing. “Organizer” means Winning Baseball Academy, LLC, operating its Dirt Bro camp and training programs. “Released Parties” are identified in Section 3. This form applies only to the camp and dates
identified below.
1. Voluntary participation; acknowledgment and assumption of risks
I voluntarily authorize participation in baseball/softball training, including throwing, catching, fielding, batting, running, sliding, diving, demonstrations, conditioning and games; use of bats, balls, nets, screens, machines and other equipment; and activity on indoor or outdoor surfaces. I understand that risks include being struck by balls or bats; collisions with athletes, coaches or objects; repetitive throwing and overuse; muscle or joint injuries; falls; equipment or surface conditions; dehydration, heat illness, cold, storms and lightning; allergic reactions; illness; and acts or omissions of others. Potential consequences include sprains, fractures, concussion or other head injury, eye or dental injuries, serious illness, permanent disability, paralysis and death. I understand these risks cannot be entirely eliminated and voluntarily assume the inherent risks and other risks to the extent permitted by law.
2. Health information, fitness and protective equipment
I represent that I have accurately disclosed the participant’s medical conditions, allergies, medications, prior concussions, limitations and emergency care needs in the confidential health section below or a separate registration record furnished before participation. I will inform staff of material changes. The participant will wear required protective gear, follow hydration and rest directions, and stop activity when feeling unwell or injured. I understand that an onsite physician, athletic trainer or medical professional may not be available. The Organizer does not provide participant health or accident insurance, and I am responsible for coverage and eligible medical expenses.
3. Release of liability, including ordinary negligence
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, in exchange for permission to participate, I release and discharge Winning Baseball Academy, LLC, Dirt Bro and any entities actually operating the identified camp; Trent Mongero; Taber Mongero; and their respective owners, officers, employees, instructors, contractors, volunteers, representatives, sponsors and host schools, facility owners/operators and other camp partners (the “Released Parties”) from claims arising out of participation, INCLUDING CLAIMS CAUSED BY A RELEASED PARTY’S ORDINARY NEGLIGENCE. This release applies to my own claims and, only where legally permitted, claims on the participant’s behalf. It does not release claims that applicable law prohibits releasing, including gross negligence, reckless or intentional misconduct where not waivable.
4. Covenant not to sue; limited indemnification
To the extent a claim has been validly released under Section 3, I agree not to sue a Released Party for that claim. To the maximum extent permitted by law, I will indemnify Released Parties for third-party claims directly resulting from my own negligent or intentional misconduct or my breach of this agreement. Nothing here requires a parent to indemnify a Released Party for that party’s own negligence or unlawfully waives a minor’s independent rights.
5. Parent or guardian consent for minors
If the participant is under the applicable age of majority, I certify that I am the parent/legal guardian with authority to approve participation. I sign on my own behalf, give participation and treatment consent, and acknowledge the listed risks. Any attempt to release claims belonging to the minor applies only if and to the extent the law of the camp state expressly permits it. I understand parental pre-injury waivers are restricted or unenforceable in some states.
6. Emergency medical authorization
In the event of injury, illness or emergency, I authorize staff to summon emergency services and arrange reasonable first aid, ambulance transportation and medical evaluation/treatment when necessary. Staff will make reasonable efforts to contact a parent/guardian or emergency contact, but urgent care need not wait for contact. I authorize disclosure of relevant health information to emergency responders to assist treatment, and accept responsibility for charges not covered by insurance. This authorization does not compel any provider to render care.
7. Concussion and injury response
The participant must immediately report possible concussion symptoms, head impacts, pain, illness or injury. Staff may stop participation for any safety concern. A participant suspected of concussion will be removed immediately, will not return that day, and may return to sports only following evaluation and clearance by an appropriate healthcare professional, consistent with applicable law and medical guidance. Staff may require additional documentation for other injuries.
8. Weather, heat and communicable illness
Camp activities may be modified, delayed, relocated or stopped for heat, air quality, storms, lightning, unsafe facilities or other conditions. The participant will follow staff directions on breaks, water, shade and shelter. The participant will not attend while sick with a communicable condition or subject to an applicable exclusion requirement. No waiver substitutes for the Organizer’s obligation to use reasonable safety practices.
9. Rules, supervision, check-in and release of minors
The participant must obey safety instructions and treat others respectfully. Staff may remove a participant who presents a safety risk or seriously violates rules. A minor must follow camp check-in/check-out procedures and may leave only with an authorized pickup person identified below or in the registration record, unless the parent/guardian separately authorizes independent departure in writing. Camp registration does not authorize staff to transport a participant in personal vehicles. Any transportation requires separate arrangements and consent. Refunds remain governed by published registration terms.
10. Athlete safety and appropriate conduct
I understand that inappropriate physical contact, harassment, bullying, abuse and private or concealed one-on-one interactions are not permitted as part of camp operations. I agree to report safety concerns to the camp director. This acknowledgment does not waive any rights or excuse misconduct. Camp staff should follow the Organizer’s written youth-protection and incident-reporting policies.
11. Camp communications; electronic signatures
I consent to operational contact at the information provided about registration, schedules, weather, logistics and safety. This is not consent to unrelated marketing texts or emails. Electronic signatures and acceptance records may be used to the extent permitted by law; the Organizer should retain the executed agreement, linked camp/date, signer identity and acceptance time.
12. Applicable law; enforceability
This form is intended for camps held in multiple U.S. states, but its validity and effect depend on applicable state law, including laws governing minors. To the extent permitted, the law of the state where the camp occurs governs claims arising from the camp, and suit may be brought in a court of competent jurisdiction serving that location. No term changes nonwaivable rights. If a provision is invalid, remaining provisions will remain in effect to the extent law allows. This waiver is not a substitute for state-specific review.
13. Acknowledgment and signatures
I HAVE READ THIS AGREEMENT. I UNDERSTAND THAT IT INCLUDES ASSUMPTION OF RISK, A RELEASE OF LIABILITY FOR ORDINARY NEGLIGENCE WHERE LEGALLY PERMITTED, A COVENANT NOT TO SUE, LIMITED INDEMNIFICATION AND MEDICAL AUTHORIZATION. I SIGN VOLUNTARILY.
